Right of Withdrawal for Consumers

(A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed professional activity.)

Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which

• you, or a third party named by you who is not the carrier, took possession of the goods, where you ordered one or more goods as part of a single order and these are delivered together;
• you, or a third party named by you who is not the carrier, took possession of the last goods, where you ordered several goods as part of a single order and these are delivered separately;
• you, or a third party named by you who is not the carrier, took possession of the last partial delivery or the last item, where you ordered goods that are delivered in several partial deliveries or items.

To exercise your right of withdrawal, you must inform us (Koinet GmbH, Vogelherd 2, 78176 Blumberg, telephone: +49 (0) 7702 4798190, email address: info@ebike-center-sued.de) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form for this purpose, but this is not mandatory.

You may also exercise your right of withdrawal online via a suitably labelled button (“Withdraw from contract” or similar wording) on our website .

If you use this online function, we will promptly provide you with confirmation of receipt on a durable medium (e.g. by email), including information on the content of the withdrawal declaration and the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient for you to send your notification that you are exercising the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (except for any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than 14 days from the day on which we receive notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this reimbursement.

We may refuse reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever occurs first.

You must return or hand over the goods to us without undue delay and in any event no later than 14 days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the period of 14 days has expired.

You bear the direct costs of returning goods that cannot be sent by parcel post. The costs are estimated at no more than approximately EUR 150 for returns within Germany and no more than approximately EUR 300 for returns from abroad.

You are only liable for any diminished value of the goods resulting from handling the goods beyond what is necessary to establish their nature, characteristics and functioning.

Exclusions from and Early Expiry of the Right of Withdrawal

The right of withdrawal does not apply to contracts

• for the supply of goods that are not prefabricated and for the production of which an individual choice of or decision by the consumer is decisive, or which are clearly tailored to the consumer’s personal needs;
• for the supply of goods that may deteriorate rapidly or whose expiry date would be rapidly exceeded;
• for the supply of alcoholic beverages, the price of which was agreed upon at the time of conclusion of the contract, but which can be delivered no earlier than 30 days after conclusion of the contract and whose current value depends on market fluctuations over which the trader has no control;
• for the supply of newspapers, periodicals or magazines, with the exception of subscription contracts.

The right of withdrawal expires prematurely for contracts

• for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery;
• for the supply of goods which, after delivery, have been inseparably mixed with other goods due to their nature;
• for the supply of audio or video recordings or computer software in sealed packaging if the seal has been removed after delivery.
